Article 3 – Applicability

These Terms & Conditions apply to all offers, orders, purchases and agreements made through the Bonvieve online store.

By placing an order, the Consumer confirms that they have read, understood and accepted these Terms & Conditions.

These Terms & Conditions are made available on the Bonvieve website and may be downloaded, saved or printed by the Consumer at any time before completing a purchase.

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect. Any invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

The Entrepreneur reserves the right to amend these Terms & Conditions at any time. Any changes will apply only to orders placed after the revised Terms & Conditions have been published on the website.

Where mandatory consumer protection laws provide greater rights than these Terms & Conditions, those mandatory legal provisions shall prevail.

Article 4 – Products and Offers

All products and offers displayed on the Bonvieve website are subject to availability and may be changed or discontinued at any time without prior notice.

Bonvieve makes every reasonable effort to ensure that all product descriptions, images, colours, sizes and specifications are accurate and up to date. However, slight variations may occur due to differences in screen settings, lighting, photography or the natural characteristics of certain materials. Such variations shall not be considered defects.

All prices displayed on the website are shown in the applicable currency and include VAT where required by law, unless otherwise stated. Shipping costs, where applicable, will be clearly displayed before the Consumer completes the purchase.

Bonvieve reserves the right to correct any typographical, pricing, technical or administrative errors, even after an order has been placed. In such cases, the Consumer will be informed as soon as reasonably possible and may choose to confirm or cancel the order without any additional costs.

Product availability, promotional offers and prices are valid only while stocks last or during the promotional period indicated on the website.

Article 5 – Orders and Agreement

The purchase agreement is concluded once the Consumer places an order through the Bonvieve website and the Entrepreneur has accepted the order by sending an order confirmation via email.

After placing an order, the Consumer will receive an electronic confirmation containing the details of the purchase. If the Consumer does not receive an order confirmation within a reasonable period, they should contact Bonvieve.

Bonvieve reserves the right to refuse, cancel or limit any order where there is a reasonable suspicion of fraud, unauthorised payment, pricing errors, product unavailability or any other legitimate reason. In such cases, any payment received will be refunded using the original payment method.

All orders are subject to product availability. If a product becomes unavailable after an order has been placed, the Consumer will be informed as soon as reasonably possible and offered either a full refund or, where appropriate, a suitable alternative.

Bonvieve uses appropriate technical and organisational measures to ensure the security of online transactions and the protection of customer information.

Article 6 – Right of Withdrawal & 30-Day Return Policy

At Bonvieve, we want you to shop with confidence. In addition to your statutory consumer rights, we voluntarily offer a 30-day return policy.

The Consumer has the right to withdraw from the purchase and return the product within 30 calendar days of receiving the order, without providing any reason.

To exercise the right of withdrawal, the Consumer must notify Bonvieve by email within the 30-day return period. The returned product must be shipped within the same 30-day period.

To qualify for a return, the product must:

  • be unused, unworn and unwashed;
  • be returned in its original condition;
  • include all original tags, labels and packaging where reasonably possible;
  • be free from damage, stains, odours or any signs of use.

For hygiene and quality reasons, Bonvieve reserves the right to refuse returns that do not meet these conditions.

The Consumer is responsible for providing proof of return, such as a shipping receipt or tracking information, until the returned package has been received by Bonvieve.

This voluntary 30-day return policy does not affect the Consumer's statutory rights under applicable consumer protection legislation.

Article 7 – Return Shipping Costs and Refunds

Unless otherwise agreed, the direct cost of returning a product is the responsibility of the Consumer.

Once the returned product has been received and inspected, Bonvieve will notify the Consumer whether the return has been approved.

If the return is approved, a full refund of the purchase price, excluding any original shipping costs (unless required by applicable law), will be processed using the original payment method.

Refunds will be issued within 14 calendar days after Bonvieve has received the returned product or, where applicable, after the Consumer has provided valid proof that the product has been returned.

Bonvieve reserves the right to withhold the refund until the returned product has been received or sufficient proof of return has been provided.

Article 8 – Exceptions to the Right of Withdrawal

In accordance with applicable consumer protection legislation, the right of withdrawal does not apply to the following products:

  • Products that have been customised or personalised according to the Consumer's specifications.
  • Sealed products that are not suitable for return for health protection or hygiene reasons once the seal has been opened, broken or removed.
  • Personal care, intimate care and women's care products where the protective seal or packaging has been opened after delivery.
  • Cosmetic, beauty or skincare products that have been opened or used after delivery.
  • Gift cards, where applicable.
  • Any other products that are exempt from the right of withdrawal under applicable law.

For hygiene, health and quality reasons, Bonvieve reserves the right to refuse returns of products that have been worn, used, washed, damaged, altered, or returned without their original packaging, labels or hygiene seals where this affects their resale value or makes them unsuitable for resale.

Nothing in this Article limits or excludes the Consumer's mandatory statutory rights under applicable consumer protection legislation.

Article 9 – Prices

All prices displayed on the Bonvieve website are shown in the applicable currency and include Value Added Tax (VAT) where required by applicable law, unless otherwise stated.

Shipping costs, import duties, customs charges or other applicable fees, where relevant, will be clearly indicated before the Consumer completes the purchase.

Bonvieve reserves the right to change product prices, promotional offers and discounts at any time without prior notice. Any price changes will not affect orders that have already been confirmed by Bonvieve.

Despite our best efforts, pricing or typographical errors may occasionally occur. Bonvieve reserves the right to correct any obvious errors relating to product descriptions, pricing, promotions or technical information. If such an error affects an order already placed, the Consumer will be informed as soon as reasonably possible and may choose to confirm the order at the correct price or cancel the order free of charge.

No rights may be derived from obvious pricing, printing or administrative errors.

Article 10 – Product Quality and Warranty

Bonvieve guarantees that all products supplied conform to the agreement, the product description provided on the website and the reasonable standards of quality, functionality and durability that may be expected under normal use.

Any manufacturer's warranty is provided in addition to, and does not affect, the Consumer's statutory rights under applicable consumer protection legislation.

The Consumer is requested to inspect the products upon delivery. Any defects, incorrect items or visible damage should be reported to Bonvieve by email within 14 calendar days after receipt of the order. Failure to notify Bonvieve within this period does not affect any mandatory statutory rights the Consumer may have under applicable law.

The warranty does not cover damage or defects resulting from:

  • normal wear and tear;
  • improper, negligent or unintended use;
  • failure to follow product care instructions;
  • accidental damage;
  • unauthorised alterations or repairs;
  • improper storage or handling.

Where a product is found to be defective due to a manufacturing fault, Bonvieve will, at its sole discretion and in accordance with applicable law, repair, replace or refund the product.

Article 11 – Delivery and Shipping

Bonvieve will process and dispatch all orders with the utmost care and within the estimated timeframe communicated during checkout.

Delivery times are estimates only and may vary depending on the destination, shipping carrier, customs clearance or circumstances beyond Bonvieve's reasonable control. Delays do not automatically entitle the Consumer to compensation.

If an unforeseen delay occurs, Bonvieve will make reasonable efforts to inform the Consumer as soon as possible.

If Bonvieve is unable to fulfil an order, the Consumer will be notified promptly and offered the choice of a full refund or, where appropriate, a suitable alternative product.

Where a refund is due following cancellation or unavailability of a product, it will be processed within 14 calendar days using the original payment method, unless otherwise agreed.

The risk of loss or damage to the products passes to the Consumer upon successful delivery to the delivery address provided by the Consumer.

Article 12 – Payment

Payment must be completed at the time of placing an order using one of the payment methods offered during checkout.

Orders will only be processed and dispatched once payment has been successfully authorised and received.

The Consumer is responsible for ensuring that all payment information provided is accurate and complete. Any errors in payment details should be reported to Bonvieve without undue delay.

Bonvieve reserves the right to refuse, suspend or cancel any order where payment cannot be authorised, where fraud or unauthorised activity is suspected, or where there is a breach of these Terms & Conditions.

All payments are processed through secure third-party payment providers. Bonvieve does not store or have direct access to the Consumer's payment card details.

Article 13 – Complaints Procedure

At Bonvieve, customer satisfaction is our priority. If the Consumer has a complaint regarding a product or our services, we encourage them to contact us as soon as reasonably possible by email at bonvive@infobonvieve.com.

Bonvieve aims to acknowledge and respond to all complaints within 14 calendar days of receipt. If additional time is required to investigate the complaint, the Consumer will be informed accordingly.

Where a complaint is found to be justified, Bonvieve will provide an appropriate solution, which may include a repair, replacement, refund or another suitable resolution, in accordance with applicable consumer protection legislation.

Submitting a complaint does not affect the Consumer's statutory rights.

Article 14 – Governing Law and Disputes

These Terms & Conditions and all agreements between Bonvieve and the Consumer shall be governed by and interpreted in accordance with the laws of Belgium.

Any disputes arising out of or relating to these Terms & Conditions or any agreement between the Consumer and Bonvieve shall be submitted to the competent courts of Belgium, unless mandatory consumer protection laws provide otherwise.

Nothing in these Terms & Conditions shall limit or exclude any mandatory rights granted to Consumers under applicable consumer protection legislation.

Article 15 – Privacy and Data Protection

Bonvieve processes personal data in accordance with its Privacy Policy and applicable data protection legislation, including the General Data Protection Regulation (GDPR). By using the website and placing an order, the Consumer acknowledges that personal data may be processed for the purpose of fulfilling the order, providing customer support and complying with legal obligations. For more information, please refer to our Privacy Policy.
